The City of Bee Cave’s lawsuit against an industrial warehouse will have a hearing on Wednesday, November 20, 2024 at 9am at the Travis County Courthouse. The hearing is open to the public.

This hearing will determine if developers must stop construction until the full trial which is expected sometime in the spring of 2025. A judge approved a temporary restraining order on Oct. 18 and extended it again until Nov. 15. A hearing was held on Nov. 12, but there was not enough time to get through questioning of all the witnesses. A second hearing was scheduled for Nov. 26 but an earlier docket date became available on Nov. 20.
Over the past month, city inspectors have identified several violations at the construction site including inadequate grading and drainage that pose significant risks to nearby waterways and the surrounding residential neighborhood.
In addition, on November 10, the city’s attorney filed an amended petition that adds KBC Advisors as an additional defendant in this lawsuit.
The petition is linked below and states “While Bee Cave residents and their City Council would not have been open to allowing an industrial distribution center smack in the middle of residential neighborhoods, the secret network of individual KBC investors viewed the project as key to their business model, which involves developing facilities for entities like Amazon. So KBC forged ahead with its plans to build an industrial complex, relying on an engineering firm they believed had insider connections with “regulatory agencies.” The result is an industrial monstrosity that sacrifices not only aesthetics, but the livability and environment of the surrounding area—all to maximize KBC’s return on investment.”
